General Terms and Conditions (GTC) for Customers

MySkillcation – Staudacher & Köttel GbR

1. Scope of Application

These General Terms and Conditions apply to all skillcations, workshops, and continuing education programs (hereinafter referred to as "Skillcations") offered by MySkillcation – Staudacher & Köttel GbR (hereinafter referred to as "MySkillcation") and booked through the MySkillcation platform. These are not package tours within the meaning of travel law pursuant to Sections 651 et seq. of the German Civil Code (BGB).

2. Role of MySkillcation

MySkillcation is the provider of the Skillcation.

For the implementation of individual Skillcations, MySkillcation may engage external, independent partners or trainers (hereinafter referred to as "External Partners"). The responsibility for the content of the training services lies with MySkillcation. No separate contractual relationship is established between the customer and the External Partner.

3. Description of Services

The specific scope of services for a Skillcation is defined by:

  • the service description on the MySkillcation website,

  • the booking information,

  • supplementary information provided during the checkout process,

  • and the optional e-learning modules of the respective Skillcation.

The following are expressly not included in the services provided by MySkillcation:

  • travel, transport, transfers;

  • accommodation and meals;

  • insurance services;

  • and other travel services.

 

This is not a package tour within the meaning of Sections 651a et seq. of the German Civil Code (BGB).

MySkillcation may provide non-binding recommendations regarding hotel and accommodation selection. These do not constitute a booking or brokerage service. The customer is solely responsible for selecting and booking accommodations.

4. Conclusion of Contract

By completing the booking process, the customer submits a binding offer to enter into a contract for participation in a Skillcation.

The contract is concluded when MySkillcation accepts the customer's offer by sending a booking confirmation in text form.

5. Prices and Payment Terms

The prices indicated during the booking process include the applicable statutory value-added tax, where applicable.

Payment is due immediately upon conclusion of the contract.

The available payment methods are displayed to the customer during the booking process.

 

6. E-Learning Modules

Digital e-learning modules may be part of individual Skillcations. Whether and to what extent e-learning modules are provided is specified in the respective service description.

Access to the e-learning modules is provided through the systems made available by MySkillcation and requires a successful booking.

MySkillcation may make individual e-learning modules available free of charge. There is no entitlement to free provision or permanent access.

7. Accommodation and Travel

The customer is responsible for organizing and paying for accommodation and travel to the respective Skillcations independently. Any recommendations regarding accommodations provided by MySkillcation are for informational purposes only and do not constitute a booking or brokerage service, nor do they establish any corresponding liability.

8. Changes and Cancellations

MySkillcation is entitled to make necessary changes to the content, schedule, or organization of the program, provided these do not significantly affect the overall character of the Skillcation.

MySkillcation may cancel a Skillcation in particular if: the minimum number of participants is not reached; cases of force majeure or comparable circumstances beyond the control of MySkillcation make implementation impossible or unreasonable; or the assigned External Partner is unavailable and no suitable replacement can be provided.

In such cases, the customer will receive a full refund of any payments already made. Further claims are excluded.

 

9. Withdrawal and Cancellation by the Customer

The customer may withdraw before the start of the Skillcation. Withdrawal must be made in text form.

The cancellation fees are determined according to the following conditions:

  • up to 30 days before the start: 20% of the participation fee;

  • up to 14 days before the start: 50% of the participation fee;

  • less than 14 days before the start: 100% of the participation fee.

The customer reserves the right to prove that MySkillcation incurred no damage or less damage.

There is no statutory right of withdrawal pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), as this is a service related to a leisure event.

 

10. Personal Responsibility and Cooperation Obligations

Personal Suitability: Participation in a Skillcation requires physical and mental fitness appropriate to the respective service description, as well as active participation by the customer. The customer is obligated to independently verify before booking whether they meet the specific requirements of the chosen Skillcation, particularly for physically demanding activities (e.g., sailing, kitesurfing, or intensive wilderness training).

By booking, the customer declares that they are not aware of any health restrictions that would prevent safe participation in the planned program content. In case of doubt, the customer is advised to seek medical advice before participating.

Assumption of Risk: Participation in practical program components, particularly in craft, sports, or outdoor activities, is at the customer's own risk and personal responsibility.

Compliance with Instructions: Safety instructions from MySkillcation and the assigned trainers must be strictly followed. MySkillcation is not liable for damages resulting from culpable disregard of such instructions or overestimation of one's abilities.

Right of Exclusion: Participants who endanger their own safety or that of others through culpable conduct, or who persistently disrupt the learning progress of the group, may be excluded from the program without entitlement to a refund.

 

11. Liability

MySkillcation is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence. Liability under the Product Liability Act remains unaffected.

For property and financial damages, MySkillcation is only liable in cases of simple negligence for breaches of essential contractual obligations, but limited to the typically foreseeable damage. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the customer may regularly rely.

Furthermore, MySkillcation is not liable for: travel and accommodation costs of the customer, unless these arose from a breach of duty attributable to MySkillcation; damages due to force majeure, unless attributable to MySkillcation; losses arising from actions of third parties who are not partners of MySkillcation and for which MySkillcation is not responsible.

 

12. Photo and Video Recordings

During the Skillcation, photos or videos may be taken by MySkillcation or authorized persons.

The use of such recordings for marketing purposes (e.g., website, social media) is only permitted on the basis of prior express consent from the respective customer. Consent is voluntary and can be revoked at any time.

 

13. Data Protection

MySkillcation processes personal data exclusively for the purpose of processing the booking and conducting the Skillcation.

14. Minors

Participation by minors is not permitted.

 

15. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is Munich, provided the customer is a merchant or legal entity.

Should individual provisions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall apply in place of the invalid provision.
