MySkillcation – Staudacher & Köttel GbR

1. Scope of Application

These Terms & Conditions apply to all Skillcations, workshops, retreats, and similar events presented on the platform of MySkillcation – Staudacher & Köttel GbR (hereinafter “MySkillcation”).
MySkillcation acts solely as an intermediary, arranging bookings for events conducted by independent third-party organizers (“Organizers”).

2. Role of MySkillcation as Intermediary

MySkillcation is not a tour operator within the meaning of § 651a of the German Civil Code (BGB).
MySkillcation does not provide any of the services forming part of the Skillcation.
Instead, MySkillcation arranges contracts between the customer and the respective Organizer.

The participation contract is concluded exclusively between the customer and the Organizer.

3. Services Provided by the Organizer

The content, scope, execution, and quality of the Skillcation are defined exclusively by:

the Organizer’s service description,
the Organizer’s own terms and conditions,
information provided directly by the Organizer,
and the Organizer’s operational decisions.

MySkillcation has no influence over the execution or quality of the event.

4. Booking and Contract Formation

By submitting a booking request via the MySkillcation platform, the customer instructs MySkillcation to arrange a participation contract with the respective Organizer.

The contract is formed only upon confirmation by the Organizer.
MySkillcation will inform the customer whether the booking has been accepted or declined.

5. Payment Processing on Behalf of the Organizer

MySkillcation is authorized by the Organizer to collect payments on behalf of and for the account of the Organizer.

This includes:

receiving participation fees,
processing payments,
issuing invoices in the name of the Organizer,
forwarding payments to the Organizer,
and retaining the agreed intermediary commission.

The Organizer remains the legal service provider and invoice issuer.
MySkillcation acts solely as a payment and booking intermediary.

6. Prices

All prices are set exclusively by the Organizer and provided to MySkillcation for display.
Price changes remain at the Organizer’s discretion.

7. Cancellation and Withdrawal

Cancellation policies are determined solely by the Organizer.

For the pilot phase, the following policy applies as provided by the Organizer:

Up to 30 days before the event: full refund
29–15 days before the event: 50% refund
From 14 days before the event: no refund

Cancellations must be declared to MySkillcation, acting on behalf of the Organizer.

MySkillcation is not authorized to make commitments beyond the Organizer’s cancellation policy.

The customer may nominate a replacement participant if the Organizer agrees and the replacement meets the participation requirements.

8. Liability of MySkillcation

MySkillcation is liable only for:

proper arrangement of the booking,
correct transmission of information between customer and Organizer,
correct payment processing on behalf of the Organizer.

MySkillcation is not liable for:

the execution or quality of the Skillcation,
cancellations, modifications, or performance issues,
damages or claims arising from the participation contract between customer and Organizer,
travel arrangements such as accommodation, transport, or arrival.

Responsibility rests solely with the Organizer.

9. Participation Requirements

Participation is only permitted for adults (18+).

The participant is responsible for ensuring:

sufficient physical and mental fitness,
compliance with safety instructions,
responsible use of materials and equipment.

The Organizer may exclude participants who pose a safety risk.

10. Photo and Video Recordings

Photo and video recordings during the event are the sole responsibility of the Organizer.

If the Organizer grants MySkillcation permission to use photo/video material for marketing purposes, MySkillcation may use such content unless the participant objects in advance.

11. Data Protection

MySkillcation processes personal data solely for:

arranging the booking,
payment processing,
communication between customer and Organizer.

Relevant customer data will be transferred to the Organizer for event execution.
Details are governed by the MySkillcation privacy policy.

12. Right of Withdrawal

For contracts relating to leisure activities with a fixed date, no right of withdrawal exists pursuant to § 312g (2) No. 9 BGB.

13. Governing Law and Jurisdiction

These Terms & Conditions are governed by German law.
The place of jurisdiction for all intermediary services is Munich, Germany.

If individual provisions are invalid, the remaining provisions remain unaffected.
